How much does the Royal Mer Commercial Guarantee cost? The Royal Mer Commercial Guarantee is included in the purchase price of the concerned product (ADRIAN sweater) and does not result in any additional charge!
Which products are covered by the Royal Mer Commercial Guarantee? The Royal Mer Commercial Guarantee applies to products in the Adrian range.
What defects are covered by the Royal Mer Commercial Guarantee? The Guarantee covers defects related to the sewing and/or accessories of the Product. In the event of a detected defect, the buyer must fill out the ROYAL MER repair form and follow the claim procedure defined by the company.
The Royal Mer Commercial Guarantee covers only the defects exhaustively listed below – excluding any other defects.
Sewing defects: Seams that tear
The following defects related to buttons and inner pockets: Broken buttons Insufficient fabric lengths (fabric that creates a hole at the seam)
Not covered under the Royal Mer Commercial Guarantee:
Material Wear: Normal wear of the material due to regular use (pilling, relaxed knit), such as fabric softening or slight discoloration, is not covered by the Guarantee. Tears/Holes/Stains: Tears, cuts, holes, or stains resulting from accidents, abnormal use, negligence, or exposure to external agents are not covered by the Guarantee. Washing Accidents: The guarantee does not cover damage (shrinkage/discoloration/pilling, etc.) that occurs to the sweater during washing. The washing of the sweater must always follow the washing conditions recommended by Royal Mer.
Labor costs and damages attributable to work performed by third parties, other than ROYAL MER or any repairer approved by us, are not covered by the Royal Mer Commercial Guarantee.
End of the Royal Mer Commercial Guarantee: The Guarantee ends if the specified conditions are not met or if the Product is no longer repairable.
What are the exclusion cases of the Royal Mer Commercial Guarantee? The Royal Mer Commercial Guarantee applies only in the case of normal use of the product according to its intended use. The following are not considered normal use of the product: Carrying or moving near inappropriate objects (sharp/piercing objects, objects emitting intense temperature, animals, or others), prolonged exposure of the product to significant hot or cold temperatures (below 0 degrees Celsius or above 50 degrees Celsius), exposure to abrasive products and surfaces as well as solvents, acids, wastewater, paints, glues.
The Royal Mer Commercial Guarantee will also not apply in any of the following circumstances:
Voluntary degradation; Deterioration during transport under inappropriate conditions (in such cases, you should approach the transport company); Defect resulting from maintenance or repair under the Royal Mer Commercial Guarantee, performed by third parties, other than Royal Mer or any repairer approved by us. Repairs not falling within the scope of the Royal Mer Commercial Guarantee may be carried out by any third party of your choice. However, repairs within the scope of the Royal Mer Commercial Guarantee must be performed by Royal Mer or any repairer approved by us;
The Commercial Guarantee is limited to the price of the concerned product and does not cover indirect damages.
What is the territorial scope of the Royal Mer Commercial Guarantee? The Royal Mer Commercial Guarantee applies only to the purchase of one or more ADRIAN sweaters made in France, subject to the above conditions.
This Commercial Guarantee is subject to the laws in force in France and is provided by ROYAL MER as proof of its commitment to the quality of its products. It is non-transferable and applies exclusively to the initial purchaser of the Product.
2. Legal Warranties The Royal Mer Commercial Guarantee, if granted, applies without prejudice to your right to benefit from the legal warranty of conformity, under the conditions set out in Chapter VII, Title I, Book II of the Consumer Code, and the warranty against hidden defects, under the conditions provided for in articles 1641 to 1649 of the civil code.
Any request made under the legal warranties must be addressed by registered letter with acknowledgment of receipt (LRAR) to the headquarters of Royal Mer – 40 Rue Levavasseur 35800 Dinard.
The consumer has a period of two years from the delivery of the goods to implement the legal warranty of conformity in case a defect in conformity appears. During this period, the consumer is only required to establish the existence of the defect of conformity and not the date it appeared.
When the sales contract for the goods includes the provision of digital content or a digital service continuously for a period of more than two years, the legal warranty applies to this digital content or digital service throughout the supply period. During this time, the consumer is only required to establish the existence of the defect of conformity affecting the digital content or digital service, and not the date it appeared.
The legal warranty of conformity obligates the professional, where applicable, to provide all necessary updates to maintain the conformity of the goods.
The legal warranty of conformity entitles the consumer to repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience to them.
If the goods are repaired under the legal warranty of conformity, the consumer benefits from an extension of six months of the initial warranty.
If the consumer requests the repair of the goods, but the seller imposes a replacement, the legal warranty of conformity is renewed for a period of two years from the date of replacement of the goods.
The consumer may obtain a reduction in the purchase price while keeping the goods or terminate the contract by obtaining a full refund against the return of the goods if:
- The professional refuses to repair or replace the goods.
- The repair or replacement of the goods occurs after a period of thirty days.
- The repair or replacement of the goods causes major inconvenience for the consumer, especially if the consumer permanently bears the costs of taking back or removing the non-conforming goods, or if they bear the costs of installing the repaired or replacement goods.
- The non-conformity of the goods persists despite the seller's unsuccessful attempt to comply.
The consumer is also entitled to a price reduction of the goods or to the termination of the contract when the conformity defect is so severe that it justifies an immediate price reduction or contract termination. In this case, the consumer is not required to request the repair or replacement of the goods beforehand.
The consumer does not have the right to terminate the sale if the conformity defect is minor.
Any period during which the goods are immobilized for repair or replacement suspends the remaining warranty until the delivery of the repaired or replaced goods.
The rights mentioned above result from the application of Articles L. 217-1 to 217-32 of the Consumer Code.
A seller who in bad faith obstructs the implementation of the legal warranty of conformity may incur a civil fine of up to 300,000 euros, which can be increased to 10% of the average annual turnover (Article L. 241-5 of the Consumer Code).
The consumer also benefits from the legal warranty against hidden defects under Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This warranty entitles the consumer to a price reduction if the goods are retained or to a full refund against the return of the goods.

In the event that Royal Mer confirms coverage of the goods under the legal warranty leading to the repair or replacement of the non-conforming product, you must return the product to Royal Mer for compliance via postal service – Colissimo, and the return must be carried out and borne by the parties in accordance with the provisions of Articles L. 217-4 and following, D. 217-1, L 241-6 and following of the Consumer Code. In this regard, Royal Mer is required to reimburse you for the shipping costs of the goods for compliance within a maximum period of fourteen days from the day you are informed of the coverage of the goods under the legal warranty. The amount owed for this is automatically increased by 10% if the reimbursement occurs within fourteen days beyond this term, 20% up to thirty days, and 50% thereafter.
